1. Introduction and acceptance of terms

These Terms and Conditions (“Terms”) form a legally binding agreement between you (“User”, “you”) and the operator of 3bit Meditation (the “App”, “Service”, “we”, “us”, “our”), operating under the brand 3bit.app, provided by [Alexey Ostapchenko: Full name of the registered individual entrepreneur (FOP)], a sole proprietor registered in Ukraine, registration number (RNOKPP) [……..], registered address [TODO] (“Operator”).

By downloading, installing, accessing, or using 3bit Meditation (available on Apple App Store and Google Play, and via our website at https://3bit.app), you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional guidelines or rules referenced herein. If you do not agree, you must not use the App.

If you are using the App on behalf of a minor, you represent that you are their parent or legal guardian and accept these Terms on their behalf.

2. Eligibility

• You must be at least 16 years old to create an account and use the App independently. If you are between 13 and 16 years old, you may only use the App with verifiable parental or guardian consent, where required by applicable law.
• The App is not directed at children under 13, and we do not knowingly collect personal data from children under 13.
• You must have the legal capacity to enter into a binding contract in your country of residence.

3. Description of the service

3bit Meditation is a digital wellness application providing guided meditations, sleep sounds, breathing exercises, focus sessions, and related mindfulness content (the “Content”), organized into categories such as Sleep, Breathing, Focus, Meditation, Anxiety Relief, and Body Scan.

• A limited selection of Content is available free of charge.
• Full access to the Content library requires an active paid subscription (‘Premium’ or ‘Pro’) as described in Section 6.
• We may add, modify, or remove Content, categories, and features at any time, including during a free trial or active subscription period, without liability to you, provided the core service remains substantially consistent with what was offered at the time of purchase.

Important: this App provides general wellness, relaxation, and mindfulness content. It is not a medical device, diagnostic tool, or substitute for professional medical, psychological, or psychiatric care. See Section 12 (Health Disclaimer).

4. Account registration

• You may be required to create an account using an email address, social sign-in, or device-based identifier.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account.
• You agree to provide accurate, current, and complete information during registration and to update it as necessary.
• You must notify us immediately at 3bit.app@gmail.com of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or are inactive for an extended period, subject to applicable law.

5. Acceptable use

You agree not to:

• Copy, reproduce, distribute, publicly perform, or create derivative works from the Content without our prior written consent;
• Reverse-engineer, decompile, or disassemble the App, or attempt to extract its source code;
• Circumvent, disable, or otherwise interfere with subscription, security, or DRM-related features of the App;
• Use automated means (bots, scrapers) to access the App or its Content;
• Use the App for any unlawful purpose or in a manner that infringes the rights of others;
• Upload or transmit viruses, malware, or other harmful code through any feature of the App;
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

Violation of this Section may result in immediate suspension or termination of your account without refund, where permitted by applicable law.

6. Subscriptions, pricing, and payment

6.1 Subscription plans

3bit Meditation offers auto-renewing subscription plans (e.g., monthly and annual) that unlock full access to the Content library. Current prices are displayed in the App and in the applicable app store listing prior to purchase. Indicative pricing: [TODO: e.g., Monthly — UAH 149 / USD 4.99; Annual — UAH 999 / USD 29.99]. Final prices may vary by region, currency, and applicable taxes, and are determined by Apple App Store or Google Play at the time of purchase.

6.2 Purchases through Apple App Store or Google Play

• If you subscribe through the iOS or Android App, payment is processed entirely by Apple Inc. or Google LLC respectively, in accordance with their respective payment terms, not by the Operator directly.
• Subscriptions automatically renew for the same duration unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period, at the then-current price.
• You can manage or cancel your subscription at any time in your Apple ID account settings or Google Play account settings. The Operator has no ability to process cancellations or refunds for purchases made through these platforms directly.
• Refunds for App Store or Google Play purchases are governed exclusively by Apple’s or Google’s refund policies, respectively. Please contact Apple Support or Google Play Support for refund requests.

6.3 Purchases through our website (web checkout)

• If you subscribe directly through https://3bit.app using a card payment processed via monobank acquiring, the Operator is the merchant of record for that transaction, and the terms in our separate “Monobank Payment Terms and Conditions” document apply in addition to this Section.
• Prices for web purchases are displayed in UAH (and may be shown in USD or EUR for reference) prior to checkout, inclusive of any applicable taxes unless stated otherwise.
• Web subscriptions may renew automatically if you have opted into recurring billing; you may cancel at any time via your account settings or by contacting us, with cancellation taking effect at the end of the current billing period.

6.4 Free trials and promotional offers

• We may offer free trials or promotional pricing at our discretion. Unless cancelled before the trial ends, the subscription will automatically convert to a paid subscription at the standard price.
• Free trial eligibility is generally limited to one trial per user/device; we reserve the right to determine eligibility and to deny abuse of promotional offers.

6.5 Refund policy

• App Store / Google Play purchases: refund requests must be directed to Apple or Google, in accordance with their consumer refund policies.
• Website/monobank purchases: subject to the right of withdrawal described in Section 6.6 below and the separate Monobank Payment Terms.
• No refunds are provided for partial subscription periods already used, except as required by applicable consumer protection law.

6.6 Right of withdrawal (digital content)

Where required by applicable consumer protection law (including in the EU/EEA and Ukraine), you may have a statutory right to withdraw from a digital content purchase within 14 days of purchase, provided that you have not already begun consuming the digital content with your express consent and acknowledgement that you thereby lose this right of withdrawal. By starting playback of any premium Content, you expressly consent to immediate performance and acknowledge the loss of the withdrawal right for that Content, to the extent permitted by law.

7. Intellectual property rights

All Content, trademarks, logos, audio recordings, visual designs, software, and other materials made available through 3bit Meditation are owned by or licensed to the Operator and are protected by copyright, trademark, and other intellectual property laws. Except for the limited, non-exclusive, non-transferable, revocable license granted to you to access and use the Content for personal, non-commercial purposes while your subscription is active, no rights are transferred to you under these Terms.

Any feedback, suggestions, or ideas you submit regarding the App may be used by us without restriction or compensation to you.

8. User-generated content

If the App allows you to submit reviews, comments, journal entries, or other content (“User Content”), you retain ownership of your User Content but grant us a worldwide, royalty-free, non-exclusive license to use, store, reproduce, and display it solely for the purpose of operating and improving the App. You represent that your User Content does not infringe any third-party rights and complies with applicable law and our Acceptable Use rules in Section 5.

9. Third-party services

The App may contain links to or integrate with third-party services (such as Apple, Google, monobank, analytics, or crash-reporting providers). We are not responsible for the content, accuracy, or practices of third-party services, and your use of them is governed by their own terms and privacy policies.

10. Privacy

Our collection and use of personal data is described in our Privacy Policy, available at https://3bit.app/privacy, which is incorporated into these Terms by reference. By using the App, you consent to the data practices described therein, in compliance with the EU General Data Protection Regulation (GDPR), Apple App Store Review Guidelines, and Google Play’s User Data policy, as applicable.

11. Notifications and communications

By creating an account, you consent to receive transactional and service-related communications (e.g., subscription confirmations, renewal reminders, security notices) by email or push notification. You may opt out of non-essential marketing communications and push notifications for reminders or promotions at any time in your device or in-app settings.

12. Health disclaimer

3bit Meditation is intended for general wellness and relaxation purposes only. The Content is not intended to diagnose, treat, cure, or prevent any disease or medical condition, and is not a substitute for professional medical or mental health advice, diagnosis, or treatment.

• Always consult a qualified physician or mental health professional before starting any new wellness practice, particularly if you have a pre-existing physical or mental health condition.
• If you are experiencing a medical or mental health emergency, including thoughts of self-harm, stop using the App and contact your local emergency services or a crisis helpline immediately.
• Use of breathing exercises and guided sessions is at your own risk. Discontinue immediately if you experience discomfort, dizziness, or distress.

13. Disclaimers and limitation of liability

To the maximum extent permitted by applicable law, the App and Content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by applicable law, the Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or goodwill, arising from your use of or inability to use the App, even if advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be limited or excluded under applicable law, including liability for death, personal injury, gross negligence, or willful misconduct.

14. Indemnification

You agree to indemnify and hold harmless the Operator, its officers, employees, and partners from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the App.

15. Term, suspension, and termination

• These Terms remain in effect for as long as you use the App.
• You may stop using the App and delete your account at any time via in-app settings or by contacting us.
• We may suspend or terminate your access to the App, with or without notice, if you breach these Terms, engage in fraudulent activity, or if required by law, without prejudice to any subscription fees already paid, except where a refund is legally required.
• Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution survive termination.

16. Changes to these Terms

We may update these Terms from time to time to reflect changes in our practices, legal requirements, or App functionality. We will notify you of material changes via in-app notice, email, or by updating the “Last updated” date above. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

17. Governing law and dispute resolution

These Terms are governed by the laws of Ukraine, without regard to conflict-of-laws principles, except where mandatory consumer protection laws of your country of residence (e.g., EU/EEA member states) grant you additional rights that cannot be waived, in which case those mandatory provisions will apply to the extent required.

Any dispute arising from these Terms shall first be addressed through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the competent courts of Ukraine, unless applicable consumer protection law grants you the right to bring proceedings in your own country of residence.

18. App store specific terms

18.1 Apple App Store

• These Terms are between you and the Operator only, and not with Apple Inc. Apple is not responsible for the App or its Content.
• Apple has no obligation to furnish any maintenance or support services for the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
• Apple is not responsible for the investigation, defense, settlement, and discharge of any third-party claim that the App infringes a third party’s intellectual property rights.
• Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a ‘terrorist supporting’ country, and are not listed on any U.S. Government list of prohibited or restricted parties.

18.2 Google Play

• Your use of the App must also comply with Google Play’s Terms of Service and Google Play Developer Distribution Agreement, where applicable.
• Google is not a party to these Terms and bears no responsibility for the App, its Content, or any liability related thereto.

19. Miscellaneous

• Entire agreement: These Terms, together with our Privacy Policy and any Monobank Payment Terms, constitute the entire agreement between you and the Operator regarding the App.
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
• No waiver: Our failure to enforce any right or provision will not be deemed a waiver of such right or provision.
• Assignment: You may not assign these Terms without our prior written consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets.
• Language: These Terms are made available in English and Ukrainian. In the event of any discrepancy, [TODO: choose the controlling version, e.g., the Ukrainian-language version controls for users in Ukraine and the English-language version controls for all other users].
